Anne--

I don’t know about other states but it is legal here. I know tons of people who have insurance and Medicaid. The charges have to be billed to the private insurance first and then the remaining billed to Medicaid. In fact, the Medicaid application has a place on it for you to list any other insurances you have. The state knows we have other insurance.

Also, SSI and Medicaid are administered by 2 different agencies. One has no bearing on the other. Medicaid is for lower income families and also those who have medical needs *chronic conditions, pregnancy, etc. SSI is for lower income children with some kind of "disability or illness".

I am very involved with the caseworkers who administer my kids’ SSI and Medicaid and I assure you that we are totally legal. I don’t know who gave you your info, but it doesn’t apply in all states.
