"identifying" your child in school

Question for you all.  It seems that the kids who are "indentified" with special needs at school get special priviledges.  I have not identified my daughters in that way for a reason- I don’t think it’s necessary.  The school has always worked with us on absences, water at the desk, med time, feeling sick, etc. so making an IEP or anything else seemed excessive to me.

My 10 year old is being picked on and assaulted by an older child on her bus.  I have dealt with the school with this for the last 2 plus weeks.  I have volunteered at the school and on the bus.  It’s made things worse.  The school’s response is that "he is special and protected" (behavioral disorder) and there are very few consequences we can give him.  I won’t go into the whole thing (too long) but this is so incredibly frustrating!  Would Ab be more protected in her rights if she too were "identified"?
